1. Acceptance of Terms

By using the Axia service offered by Finaxis inc., you agree to these terms of use. If you do not accept these terms, please do not use the service.

2. Service Description

Axia is an on-demand AI collection agent. The service allows you to draft and send follow-up communications (email and SMS) to your debtors, under your supervision and with your prior approval for each message sent.

3. Payment and Billing

The service is offered in the form of usage time blocks, payable in advance via Stripe. Time is only deducted when the agent is actively working. No refunds are offered for unused time, except at the discretion of Finaxis inc.

4. Mandatory Business Relationship

The Axia service is intended exclusively for the collection of debts arising from an existing business relationship between you and your debtor. By using the service, you attest that a legitimate business relationship exists with each debtor targeted by a follow-up (contract, invoice issued for goods or services rendered, commercial agreement, etc.). Finaxis inc. reserves the right to refuse or suspend the sending of any communication if tangible proof of this business relationship cannot be provided. Using the service for solicitation, harassment, or the collection of fictitious debts is strictly prohibited.

5. User Responsibilities

You are responsible for the accuracy of the information provided to the agent (invoices, amounts, debtor contact information). You are responsible for approving each communication before it is sent. Finaxis inc. is not responsible for consequences related to inaccurate information or communications that you have approved.

6. Limitation of Liability and Waiver

You are solely responsible for communications sent via the Axia service, including their content, recipient, and frequency. In the event of a complaint, dispute, or lawsuit arising from a communication sent through the service, you assume full responsibility. You irrevocably waive any recourse, claim, or legal action against Finaxis inc., its officers, employees, and subcontractors in connection with any direct or indirect consequences arising from the use of the service. This waiver applies without limitation to financial damages, reputational harm, and any business losses.

7. Service Limitations

Axia is a communication assistance tool. The service does not constitute legal advice and does not guarantee the recovery of amounts owed. For cases requiring legal action, we recommend consulting a legal professional.

8. Intellectual Property

The Axia service, its interface, code, and algorithms are the property of Finaxis inc. Communications drafted by the agent on your behalf belong to you.

9. Modification of Terms

Finaxis inc. reserves the right to modify these terms at any time. Changes take effect upon publication on this page.

10. Governing Law

These terms are governed by the laws of Quebec and Canada. Any dispute shall be submitted to the competent courts of the district of Montreal.

11. Report Abuse or Spam

If you have received a communication from Axia that you consider unsolicited, abusive, or fraudulent, please report it immediately by clicking here. Every report is handled diligently. Finaxis inc. reserves the right to immediately suspend the account of any user subject to a substantiated report.
